February 22, 2010 Legislative Update

So, here is the latest scoop on current House Bills pending with the Arizona Legislature.  Some of them make sense, others do not.

House Bill 2153.  It says that a Planned Community cannot regulate regulate activity on public streets.  Passed the House by a vote of 46-14-3.  Currently in the Senate.

House Bill 2641.   Changes the unanimous consent requirements in ARS 33-1227(D) to 3/4 of the unit owners. 

House Bill 2476.   The Condominium Act currently requires unanimous consent of all the owners to amend the “use to which any unit is restricted.”  This bill strikes that requirement.    

House Bill 2753.  Places regulations on Managers.

House Bill 2783.  Makes it a violation of the law for a Planned Community or Condominium to restrict minimum and maximum rental periods of homeowners in communities where some form of rentals is allowed.

House Bill 2778.  Places limitations on what Planned Communities and Condominiums can regulate when it comes to “Rainwater Harvesting Systems” that act as “water saving devices.”
